Legal & Acceptable Use

1. Nature of the service
NoctuaPC AgentSupport ("the Service") is a tool that enables a technician to remotely view and control computers with the consent of their owner. NoctuaPC provides the technology only. NoctuaPC is not responsible for how the Service is used by technicians or any third party, nor for the content, actions, or consequences arising from any remote session.
2. Lawful use & user responsibility
You are solely responsible for your use of the Service and must comply with all applicable laws and regulations. In particular, you must:
- obtain the explicit authorization of the owner/user of every computer before accessing or controlling it;
- not use the Service for any unlawful, fraudulent, abusive, or unauthorized purpose;
- not use the Service to access data or systems you are not entitled to access.
Any unlawful use is strictly prohibited and may result in immediate account suspension.
3. Disclosure to authorities
NoctuaPC cooperates with law enforcement. If lawfully requested by a competent authority (subpoena, court order, or valid legal process), we will disclose the information in our possession (account details, connection logs, audit records) to the extent required by law.
4. Geographic restrictions (U.S. sanctions compliance)
The Service is operated in accordance with United States law and U.S. economic sanctions (OFAC). It is not available, and may not be used, in or on behalf of comprehensively sanctioned or embargoed jurisdictions. Prohibited jurisdictions currently include:
- Cuba
- Iran
- North Korea (DPRK)
- Syria
- Russia
- Belarus
- The Crimea, Donetsk (DNR) and Luhansk (LNR) regions of Ukraine
This list follows U.S. sanctions programs and may change without notice. By using the Service you certify that you, your clients, and the computers you access are not located in, and are not ordinarily resident in, a prohibited jurisdiction, and that you are not a person or entity subject to U.S. sanctions (e.g., OFAC SDN List). We aim to be 100% U.S. compliant and reserve the right to refuse or terminate service to remain so.
5. Limitation of liability
The Service is provided "as is", without warranty of any kind. To the maximum extent permitted by law, NoctuaPC shall not be liable for any indirect, incidental, or consequential damages, nor for any loss arising from the use of, or inability to use, the Service.
